THE SHIELDS ARE PROVIDED “AS-IS,” AND ACTUATED MEDICAL DISCLAIMS ALL WARRANTIES, INCLUDING ANY (A) WARRANTY OF MERCHANTABILITY; OR (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE. ACTUATED MEDICAL SPECIFICALLY DISCLAIMS THAT THE SHIELDS WILL PREVENT INFECTION OR THE TRANSMISSION OF VIRUSES OR DISEASES, INCLUDING COVID-19/CORONAVIRUS. ACTUATED MEDICAL FURTHER DISCLAIMS THAT THE SHIELDS WILL PREVENT PERSONAL INJURY OR DEATH. BUYER BEARS THE ENTIRE RISK AS TO THE PERFORMANCE, OPERATION, AND QUALITY OF THE SHIELDS.

Buyer acknowledges and understands that the shields have not been industry tested and may cause injury. Buyer agrees to indemnify, defend, and hold Actuated Medical harmless against any and all liability or loss arising in conjunction with or resulting from use of the shields (including any and all attorneys’ fees and expenses incurred by Actuated Medical).
